This Privacy Policy describes the manner in which NextCare Urgent Care and its affiliates and subsidiaries (“NextCare” or “Us”) collect, use, maintain and disclose information collected from users (“you” or a “User”) of the NextCare mobile application (“App”). This Privacy Policy applies to the App and all products and services offered by NextCare related to the App. You must agree to the Privacy Policy and the Terms of Use to use the App. If, after reading the Terms of Use and this Privacy Policy, you do not agree, you cannot use the App.
NextCare collects personally identifiable information that you provide to us when you:
NextCare collects and processes a subset of personal information that is your protected health information, or “PHI.” PHI is subject to the Health Insurance Portability and Accountability Act (“HIPAA”). This information is generally not considered personally identifiably unless it is combined with your NextCare account, contact information, other account information, or other information that is unique to you. NextCare may combine this information with your NextCare username, contact information, other account information, or other unique information in order to provide the services that you have requested, to troubleshoot problems, or to provide better service to you or other Users.
The App uses unique device identifiers (“UDID”) or other tracking capabilities to enhance User experience. The UDID is an identifier that uniquely identifies your device and allows the App to recognize you and your device when you return to the App. UDID and the other tracking technologies used by the App are intended to improve User experience. For example, the UDID can help the App remember you between visits. You can set your device to refuse cookies, or to alert you when cookies are being sent. It is not possible to refuse the UDID, as that is necessary for the App to work. However, the information from the UDID is only used to make the App work as well as possible for you.
NextCare uses Google Analytics, which uses the UDID to analyze traffic on the App. For instance, Google Analytics tells NextCare how many people have used the App, how they move through the App, and how long they spend on each area of the App. NextCare typically do not connect this analytical information with identifiable information like name or phone number, although the analytics may associate information with a geographic location, or device identifier.
Health is a sensitive topic. NextCare has implemented safeguards that help assure that NextCare commits to collect, process and use personal information in accordance with applicable laws, including HIPAA. We use https for secure communication between servers and we maintain internal policies and processes that limit access to your information to our staff who need to know the information to perform their jobs.
NextCare does not sell, trade, or rent your personal identification information to others. NextCare may share information about Users of the App:

Users may find advertising or other content on the App that link to the sites and services of NextCare partners, suppliers, advertisers, sponsors, licensors and other third parties. NextCare do not endorse the products of those companies, do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from the App. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website is subject to that website’s own terms and policies. NextCare encourages you to read the terms and policies of any third-party site or service you navigate to.
The App is intended to be used by individuals over the age of 18. NextCare does not knowingly collect personal information from children under 13 years of age. If NextCare becomes aware that NextCare has collected personal information from a child under 13 years of age, NextCare will promptly remove such information. If you believe NextCare has collected information from your child, please notify us through “Contact Us”.
Many internet browsers have “Do Not Track” features which, when turned on, send a signal (the “DNT signal”) to websites and applications a user visits that indicates the user does not
want to be tracked. Because there is not yet a common understanding of how to interpret DNT signals, and there is no common definition of “tracking”, we do not currently respond to DNT signals. You can learn more about Do-Not-Track at https://allaboutdnt.com/.
If your information needs updated, corrected, or deleted, please notify NextCare using the contact information provided below. Your personal information can only be deleted in accordance with NextCare data retention policy, and as permitted by law. Further, personal information may remain in databases, access logs, backup media, and other records. NextCare cannot update or remove information from records of third parties.
NextCare has the discretion to update this Privacy Policy at any time. When NextCare does so, NextCare will revise the “updated” date at the top of this page. NextCare encourages Users to frequently check this page for any changes to stay informed about how NextCare collects and uses your information. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and become aware of modifications.
If you are using the App when outside the United States of America, your information will be transferred to, stored, and processed in the United States. The privacy laws of the United States may not be as protective as those in other jurisdictions. By using the App, you acknowledge that NextCare collects and processes your data as described in this Privacy Policy. NextCare collects and uses information as reasonably necessary to fulfill your requests for suggested support resources, to operate NextCare, and to comply with law. You acknowledge that these are acceptable reasons to collect and process your data. You also consent to the transfer of your information to the United States and the use and disclosure of your information as described in this Privacy Policy. If you want NextCare to correct, delete, or no longer process your data, please contact us at the “Contact Us” address below. You understand and agree that a request for NextCare to delete or no longer process your data means that you can no longer use the App, because it is necessary for NextCare to generate suggested support resources on the App.
